1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Habibti ("we," "us," or "our"), governing your access to and use of the Habibti platform at habibti.chat ("the Service"). By creating an account, accessing, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not create an account or use the Service. We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will notify you of material changes via email or in-app notice at least 14 days before they take effect.

2. Nature of the Service

Habibti is a live video chat platform that pairs users for short, anonymous video conversations. The Service is designed for respectful, lawful conversation between adults. Habibti is not a recording service, broadcasting service, or content distribution platform.

By using Habibti, you agree to interact with other users respectfully and in accordance with these Terms and our community guidelines. Use of the platform for any unlawful purpose, or for harassment, abuse, sexual content, or other prohibited conduct described in Section 5, is a violation of these Terms and may result in account termination.

3. Eligibility

To use Habibti, you must:

• Be at least 18 years of age.
• Be legally able to enter into a binding contract in your jurisdiction.
• Not be prohibited from using the Service under any applicable law or regulation.
• Not have been previously banned, suspended, or removed from Habibti for a Terms violation.

By creating an account, you represent and warrant that you meet all of the above eligibility requirements. If we discover that you do not meet these requirements, we may terminate your account immediately without notice.

4. Your Account

You sign in to Habibti using a third-party authentication provider (such as Google OAuth). You are responsible for:

• Maintaining the security of your authentication account and your Habibti session.
• All activity that occurs under your account, whether or not you authorized it.
• Providing accurate, truthful, and complete profile information. Misrepresenting your age, identity, or photos is a serious violation of these Terms.
• Keeping your profile information current and up to date.
• Notifying us immediately if you suspect any unauthorized access to or use of your account.

You may not create multiple accounts, share your account with any other person, transfer your account to another person, or use another person's account. Violation of these account rules may result in immediate termination. If you suspect unauthorized access, contact us immediately at loveisblindhabbibi@gmail.com.

5. Prohibited Conduct

Habibti is committed to providing a safe and respectful environment for all users. The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban without refund:

5.1 Harassment and Abuse

• Harassing, bullying, intimidating, or threatening other users in any form.
• Using abusive, hateful, discriminatory, or derogatory language.
• Stalking or repeatedly contacting a user who has indicated they are not interested.
• Making threats of violence, self-harm, or harm to others.
• Engaging in any form of emotional manipulation or coercive behavior.

5.2 Inappropriate Content and Behavior

• Nudity, sexual content, or sexually explicit behavior during video calls.
• Uploading inappropriate, obscene, or offensive profile photos.
• Sharing pornographic, sexually suggestive, or indecent material in any form.
• Displaying illegal substances, weapons, or violent imagery during calls.
• Engaging in behavior that violates our community guidelines or applicable law.

5.3 Fraud, Deception, and Misrepresentation

• Using fake photos, impersonating another person, or misrepresenting your identity (catfishing).
• Misrepresenting your age or identity in any material way.
• Soliciting money, gifts, financial information, or personal financial details from other users.
• Promoting commercial products, services, businesses, or any form of advertising.
• Phishing, spamming, or distributing malicious software or links.

5.4 Recording and Privacy Violations

• Recording, screenshotting, screen-capturing, or otherwise capturing video calls without the explicit consent of the other participant (beyond our platform's built-in abuse reporting system).
• Distributing, publishing, or sharing any recordings, screenshots, or images from video calls.
• Attempting to identify, locate, or contact users outside the platform without their consent.

5.5 Platform Abuse

• Attempting to bypass security measures, exploit vulnerabilities, or reverse-engineer any part of the platform.
• Using bots, scripts, crawlers, or automated tools to interact with the Service.
• Interfering with or disrupting the Service, servers, or networks connected to the Service.
• Filing false, malicious, or frivolous abuse reports.
• Creating accounts for the purpose of violating these Terms or assisting others in doing so.

6. Abuse Reporting

Habibti provides an in-call abuse reporting system to protect users during video calls. When you report another user during a video call, a screenshot may be automatically captured to support the investigation. Our trust and safety team reviews all reports and takes appropriate action, which may include warnings, temporary suspensions, or permanent bans.

By using the video call feature, you consent to the possibility that a screenshot of your call may be captured if the other participant files a report. Abuse of the reporting system (including filing false, retaliatory, or frivolous reports) is itself a serious violation of these Terms and may result in account termination.

7. Subscriptions and Billing

7.1 Free Tier

New users receive 10 free video calls. Each free call has a maximum duration of 5 minutes. Once your free calls have been used, a premium subscription is required to continue making video calls on the platform. Free calls cannot be replenished, transferred, or carried over.

7.2 Premium Subscription

The Habibti premium subscription is available on both monthly and annual billing cycles. Premium features include unlimited video calls with extended call durations of up to 60 minutes per call, audio-only mode, and camera toggle functionality. Pricing may vary by region. The exact price for your subscription will be displayed to you before you complete your purchase.

7.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date.
• For monthly subscriptions, you will be charged on the same calendar date each month (or the last day of the month if the original date does not exist in a shorter month).
• For annual subscriptions, you will be charged on the anniversary of your original subscription date.
• All payments are processed securely through our third-party payment processor. We do not store your payment card details on our servers.
• You authorize the recurring charge to the payment method you provide at the time of purchase until you cancel your subscription.

7.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings on the platform.
• Cancellation takes effect at the end of your current billing period. You will retain access to premium features until then.
• We generally do not offer refunds for partial billing periods, whether monthly or annual. Subscriptions are non-refundable once the billing period has begun, except as required by applicable law.
• If you believe you were charged in error, or if you have extenuating circumstances, contact us at loveisblindhabbibi@gmail.com within 14 days of the charge and we will review your case.
• If your account is terminated by us due to a violation of these Terms, you are not entitled to a refund for any remaining subscription period.

7.5 Price Changes

We reserve the right to change subscription pricing at any time. If we change the price of your subscription, we will provide you with at least 30 days' advance notice before the new price takes effect. The notice will be sent to the email address associated with your account. If you do not agree to the new price, you may cancel your subscription before the price change takes effect. Continuing your subscription after the new price takes effect constitutes your acceptance of the new price.

8. Account Freezing, Suspension, and Termination

We reserve the right to freeze, suspend, or permanently terminate your account at our sole discretion if we determine that you have violated these Terms, pose a safety risk to other users, or are otherwise misusing the platform. Actions we may take include:

• Warning: For minor first-time violations, we may issue a written warning and allow you to continue using the Service.
• Temporary suspension: Your account may be temporarily suspended pending investigation of a report or alleged violation. During suspension, you will not be able to access the Service.
• Permanent ban: Severe violations (including but not limited to harassment, nudity, threats, fraud, or recording violations) may result in immediate and permanent removal from the platform with no prior warning.

If your account is terminated for a violation of these Terms, you are not entitled to a refund for any remaining subscription period. You may appeal a ban by contacting loveisblindhabbibi@gmail.com. We will review appeals in good faith, but we are not obligated to reinstate any account.

9. Intellectual Property

The Habibti name, logo, website design, user interface, pairing algorithms, software, and all associated content and materials are the intellectual property of Habibti and are protected by applicable copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on our platform or any part thereof without our prior written permission.

You retain ownership of the content you upload to Habibti (including profile photos and profile information). By uploading content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content solely for the purpose of operating, promoting, and improving the Service. This license terminates when you delete your content or your account, except where your content has been shared with or viewed by other users and cached or stored by them before deletion.

10. User Content

You are solely responsible for all content you share on Habibti, including profile photos, profile text, and anything you display, say, or share during video calls. You represent and warrant that:

• You own or have the legal right to share all content you upload or display.
• Your content does not infringe on the intellectual property, privacy, publicity, or other rights of any third party.
• Your content complies with these Terms, our community guidelines, and all applicable laws and regulations.
• Your content is truthful and does not contain false, misleading, or deceptive information.

We reserve the right to review, remove, or disable access to any content that violates these Terms, without prior notice. We are not obligated to monitor user content but may do so at our discretion to ensure platform safety.

11. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the Service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components.
• We are not responsible for the conduct, actions, statements, or representations of any other user, whether online or offline, including in video calls or any interactions that may occur outside the platform.
• We do not perform background checks, criminal history checks, or identity verification on users and make no representations or warranties regarding the identity, character, intentions, or suitability of any user.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.
• Our total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the total amount you have paid to us in the 12 months immediately preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

You acknowledge that Habibti is a live video chat service and that you use it at your own risk. Exercise caution and good judgment when interacting with other users. We strongly recommend taking appropriate safety precautions if you choose to meet any user in person.

13. Indemnification

You agree to indemnify, defend, and hold harmless Habibti and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees and legal costs) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property, privacy, or publicity rights; (d) any content you upload, post, or share through the Service; or (e) any dispute between you and another user of the Service.

14. Dispute Resolution

If you have a dispute with Habibti, we encourage you to first contact us at loveisblindhabbibi@gmail.com to attempt informal resolution. Most concerns can be resolved promptly through our support team.

If informal resolution is not successful within 30 days of your initial contact, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis, conducted in accordance with the rules of the American Arbitration Association, except where prohibited by applicable law. You agree to waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding. The arbitration shall take place in the State of Delaware, United States, unless otherwise agreed by the parties.

15. Termination

You may terminate your account at any time by deleting it through your account settings or by contacting us at loveisblindhabbibi@gmail.com. We may terminate or suspend your account at any time, with or without cause, and with or without notice, including but not limited to situations involving violation of these Terms.

Upon termination:

• Your right to access and use the Service ceases immediately.
• Your profile will no longer be visible to other users.
• Any active subscription will be cancelled. If termination is for cause (violation of these Terms), no refund will be issued for the remaining billing period.
• Data deletion will proceed in accordance with our Privacy Policy.

The following sections of these Terms shall survive termination and continue to apply: Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and any other provisions that by their nature should survive.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal proceedings not subject to binding arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

17. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habibti regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
• Assignment: You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, epidemics, government actions, or failures of third-party services.
